1. About These Terms
These Terms & Conditions (“Terms”) apply to all services provided by Huron Technical Solutions LLC (“HTS,” “we,” “us”) to you (“Client,” “you”), whether on-site, remote, or by drop-off or pickup.
By booking, requesting, or authorizing any service from HTS, or by allowing work to begin, you agree to these Terms. Where practical, we show these Terms before you book or before work begins, and we keep a record of the version you accepted. Our Privacy Policy explains what information we collect and how we use it, and it forms part of your agreement with us.
Electronic agreement. Booking an appointment online, checking an agreement box, confirming service by text or email, or signing a work authorization electronically counts as your electronic signature and your agreement to these Terms, as allowed by Michigan’s Uniform Electronic Transactions Act (MCL 450.831 et seq.).
2. Our Services
What we do
HTS provides technology services for homes, small businesses, and churches, including computer and phone repair, custom PC builds and console repair, smart home and TV setup, networking and WiFi, data backup and recovery, office device setup, website design, and managed IT support.
Our standard of care
We work with commercially reasonable skill, care, and professionalism. Technology can be unpredictable, so we cannot guarantee specific results or timelines. What we do promise is honest effort and clear communication.
Estimates
Quotes, timelines, and estimates are good-faith projections based on what we know at the time. Actual time and results can vary depending on a device’s condition, complexity, prior repairs, or problems discovered during service. We’ll tell you promptly about any significant change.
Compatibility
We do not guarantee compatibility between hardware, software, operating systems, firmware, or third-party services.
Third-party services
Software, cloud services, domain registrations, and hardware recommended or installed by HTS are governed by their own manufacturer or vendor terms and licenses. HTS is not a party to those agreements and is not responsible for third-party service outages or policy and price changes.
Data recovery
Data recovery is a best-effort service. We cannot guarantee that any lost, deleted, or damaged data can be recovered.
Regulated information
We do not currently provide services on systems that hold regulated health, legal, or financial-institution data, or on school student-record systems. Please let us know before booking if your device or network falls into one of these categories.
3. Booking & Scheduling
- Hours. We’re generally available Monday through Saturday, 8am to 8pm.
- Booking. Appointments are made by phone or through our online scheduler. By booking, you confirm you have the authority to approve service on the device or network involved.
- Arrival window. To make sure every client is taken care of in a timely manner, we give a time range for our arrival rather than an exact time. Earlier appointments can run long, so please allow for a reasonable delay. We’ll keep you updated by phone or text if we’re running behind.
- Emergency service. If you need help right away, including outside our normal hours, we may be able to come. Emergency service is billed at up to two times (2x) our standard rate. Whether an emergency rate applies, and how much, is at our discretion. We’ll tell you the rate before we come, and you must approve it before we proceed.
- Service area. We serve Port Huron, St. Clair County, and the Thumb area. Jobs outside our usual service area may be quoted separately, and we’ll confirm any added charge before the appointment.
- Cancellations. Please give at least twelve (12) hours’ notice to cancel or reschedule. Late cancellations (under 12 hours) and no-shows may be charged a $25.00 fee to cover our reserved time and administrative costs, invoiced immediately or added to your next invoice. We won’t charge the fee where the law doesn’t allow it. Repeated no-shows may mean we ask for prepayment on future bookings.
- If we need to reschedule. Severe weather, emergencies, or running late from a previous appointment can happen. We’ll give you as much notice as we can and rebook at your earliest convenience.
4. Pricing & Payment
Rates
- On-site: $75.00 per hour
- Remote: $45.00 per hour
- Emergency service: up to two times (2x) the rate above, as described in Section 3
On-site appointments carry a one (1) hour minimum labor charge, which covers travel, preparation, and setup. The exception is a quick job: if we can finish the job in thirty (30) minutes of on-site time or less, the charge is a flat $50.00. Website design and managed IT support are quoted by project or plan (see Section 13). Current pricing is always confirmed at booking. If a rate changes, the new rate applies only if we tell you before the affected work begins.
Billing by the half hour
Beyond the first hour, on-site time is billed by the half hour, rounded up. Each full hour is $75.00 and a leftover half hour is $50.00. For example, 1 hour 15 minutes is billed as 1.5 hours ($125.00), 1 hour 45 minutes as 2 hours ($150.00), and 2 hours 10 minutes as 2.5 hours ($200.00). Remote support is billed differently: because the remote rate is already low, it is $45.00 per hour with a one (1) hour minimum, and any part of an hour is billed as a full hour. The half-hour and quick-job pricing above applies to on-site service only.
No separate diagnostic fee
We don’t charge a separate diagnostic fee. If we’re unable to fix the issue, or the repair needs parts that aren’t on hand, we bill the applicable minimum: a flat $50.00 if the work took thirty (30) minutes or less, otherwise the one-hour minimum, or the time actually worked if it’s longer. An unsuccessful repair doesn’t entitle you to a refund of labor already performed.
When payment is due
Payment is due when service is complete, and we’ll send an invoice. For remote sessions, we bill after the session is finished. For larger jobs, we may ask for payment before we begin.
How you can pay
We accept cash, check, credit and debit card, Zelle, and Venmo. We do not add a surcharge for card payments.
Late payments
If an invoice is unpaid thirty (30) days after its due date, a flat $25.00 late fee applies to cover our administrative costs, and an additional $25.00 for each further 30-day period the balance stays unpaid. These fees are stated on our invoices. We may pause future services or pursue lawful collection of unpaid balances. If legal action becomes necessary, you’re responsible for collection costs and reasonable attorney fees to the extent a court awards them or the law otherwise allows.
Tips
Tips are never expected, and always appreciated.
5. If the Job Changes
Sometimes we find more going on once we’re hands-on. If the scope changes significantly from what we discussed, we will stop, explain what we found and what it would add in time or cost, and get your approval before doing any extra billable work. Text or email approval is fine. You will only be charged for added work that you agreed to. If you decline a change, we may stop at the agreed scope, and charges for work already authorized and performed remain due.
6. Parts & Hardware
- You supply the parts. We do not sell or purchase parts, hardware, or software licenses. You’re responsible for obtaining the correct parts for your device. We’re happy to answer compatibility questions beforehand, but you are responsible for the authenticity, condition, and suitability of the parts you provide.
- Defective or incorrect parts. We are not responsible for a part you supply or for its cost, including parts that are defective, dead on arrival, counterfeit, damaged, or incompatible, or for damage to your device caused by the part itself. This does not limit Section 11 (“If we cause damage”) if our own negligence causes damage. If a supplied part fails or doesn’t work, we’ll talk with you about the best way forward.
- Time on supplied parts is billable. Time spent opening the device, installing, testing, troubleshooting, or removing a part you supply is billable at our standard rate, even if the part turns out to be faulty, because it is time spent on the job.
- If you believe we caused the problem. If you can show that a part or device was working properly before we installed or worked on it, we’ll review the situation with you in good faith, and repair or replacement will be open for discussion under Section 11.
7. Your Responsibilities
- Ownership. You confirm you own the device or network, or are authorized by the owner to request service.
- Accurate information. Please tell us what you know about the issue and the device’s history. Incomplete information can affect the quality, timeline, or cost of service.
- Back up your data. You are responsible for backing up all important data before service begins. Technical work carries inherent risk of data loss, even with reasonable precautions.
- Access and passwords. Please give us reasonable access and workspace. We ask for passwords only when necessary, and we prefer that you enter them yourself. We encourage you to change any password you shared with us after service.
- Adult present or authorized. An adult (18 or older) with authority to approve the work must be present during all on-site service. For remote sessions and drop-offs, the person authorizing the work must be 18 or older.
- Software and licensing. We do not verify software licenses. You confirm you have the right to use any software you ask us to install, and we will not install cracks, key generators, activators, or similar tools.
- Cameras and recording devices. Before we install any camera or recording device, you must plan the locations and have them approved by whoever is legally responsible for the property, such as the owner, landlord, employer, or association. You are responsible for complying with all laws on video and audio recording and notice. We install only in locations you have approved, and we may decline an installation that appears unlawful or unsafe.
- Safety and conduct. We may end service and leave immediately if the work environment is unsafe or unsanitary, or if our technician is harassed, threatened, or treated inappropriately. In that case you will be billed the on-site minimum.
8. Your Data & Remote Access
During service we may need to access files, settings, accounts, or system information. We only access what is necessary to complete the work. We do not keep copies of your files after service ends. Temporary working copies or logs may exist during service, and we delete them when the job is done unless you ask us to keep a backup. The only customer information we retain is your appointment details. Your files and content remain yours.
For remote support, you give us temporary access to your device for the requested service only. Remote sessions happen in real time, with your knowledge and consent, and access ends when the session ends. We disconnect when the session is finished, and we do not keep persistent or unattended access to your device unless you authorize it in writing, for example in a managed IT plan.
We do not search your device for unlawful content. If we incidentally come across content involving the exploitation of children, other serious crimes, or an imminent threat, we may stop work immediately, we will not copy it, and we may report it to law enforcement as the law permits. Nothing in these Terms creates a duty for us to monitor, audit, inspect, or report content.
Details on how we handle appointment and payment information, who we share it with, and your choices are in our Privacy Policy.
9. Photos & Records
Documentation photos. We may photograph your equipment before and after our work to record its physical condition, for our internal records only. We avoid capturing personal information, on-screen content, faces, or identifying details. If you prefer that we not photograph your equipment, tell us before service begins and we won’t.
Public use. We will post photos of your equipment on our website or social media as visual testimonials only if you give separate permission, in writing or by checking the photo-permission box when you book. Permission to document our work is not permission to post. Any photo we post will not show personal information, on-screen content, faces, or your address.
Withdrawing permission. You may withdraw permission to post at any time by contacting us, and we will remove the photos under our control within a reasonable time. We can’t control copies that others have already shared.
10. Our 24-Hour Return Policy & Warranties
If the same issue we worked on returns, or a new problem is directly caused by our work, within twenty-four (24) hours after we complete the service, contact us promptly and we’ll return to fix it free of charge, subject to scheduling availability. The 24 hours begin when the original service is completed.
This does not cover new or unrelated problems, new damage or misuse, changes made by someone else, normal wear and tear, problems with parts you supplied, or malware re-infection after service caused by browsing, downloads, email, or other user activity. A re-infection is a new service, and any new or unrelated work is billed at our standard rates.
Other than this 24-hour return policy, we do not offer warranties on our work, on devices we work on, or on parts. Manufacturer warranties stay with the manufacturer. Nothing in this section limits a right that the law does not allow us to limit.
11. Risks, Damage & Liability
Inherent risk
Technical work carries risk, including data loss, hardware failure, software corruption, or in some cases complete device failure. These risks are higher with aging, previously damaged, modified, or previously serviced equipment.
Drop-off, pickup, and transit
If you drop off a device or we pick one up, you are responsible for packaging it safely unless we are the ones transporting it. While a device is with us in transit or in our temporary custody for off-site service, we handle it with reasonable care, but we are not responsible for loss or damage caused by unforeseen transit accidents, severe weather, or other events outside our reasonable control.
Higher-risk devices and swollen batteries
Lithium-ion batteries that are swollen, bulging, leaking, punctured, or heat-damaged can vent or catch fire without warning, and opening or handling the device can set that off. The same is true of liquid-damaged, burned, or visibly unsafe equipment. If we find or suspect one of these conditions, we may stop work, decline to handle the device, or suggest that you have it serviced elsewhere.
If we agree to proceed, we will explain the hazard and ask you to confirm by text or in writing that you want us to go ahead. By confirming, you accept the inherent risks of the hazardous condition, including fire, smoke, injury, and damage to the device, its data, and nearby property. We will use due caution, and HTS is not responsible for those results except where caused by our gross negligence or willful misconduct. Time spent inspecting the device is billable at our on-site minimum. A damaged battery should be recycled at an approved facility, and should not be transported without proper safety guidance.
Pre-existing conditions
We are not responsible for pre-existing damage, hidden or manufacturing defects, normal wear and tear, or deterioration from age or prior use. We’ll do our best to note the condition of your device before work begins.
If we cause damage
If damage to a device is directly and solely caused by our negligence during service or while in our custody, our responsibility is limited to repairing the affected component or replacing it with one of comparable functionality and value, at our choice, and will not exceed the fair market value of the affected device immediately before the damage.
Limits on liability
To the maximum extent allowed by Michigan law, we are not liable for indirect, incidental, special, or consequential damages, including loss of data, business, profits, or use. Except as stated under “If we cause damage,” our total liability for any claim will not exceed the amount you paid for the specific service involved. We are not liable for data loss except in cases of our gross negligence. None of these limits apply to gross negligence or willful misconduct, and nothing in these Terms limits any right you have under Michigan or federal law that cannot be waived.
Indemnification
You agree to reimburse HTS for reasonable losses and costs, including reasonable attorney fees, from third-party claims arising from your misrepresentation of ownership or authority to approve service, your unlawful use of a serviced device, or software you provided or asked us to install without a valid license. This does not apply to the extent a claim is caused by our own negligence, gross negligence, or willful misconduct.
12. Devices Left With Us
Please pick up your device promptly after service. Michigan law (MCL 570.187) may give us a possessory lien on property we have repaired or worked on, which lets us keep it until the charges are paid. If charges remain unpaid, we will contact you. If the property stays in our possession unpaid for nine months, the statute allows a public sale after at least thirty (30) days’ written notice sent by registered mail, with any surplus handled as the law requires.
We will keep, sell, or dispose of a device only as that law and other Michigan law allow. Nothing in these Terms gives us ownership of your device or a right to sell it beyond what the law provides.
13. Websites & Managed IT
Website projects are quoted by project, with a written scope and price agreed before work begins. You own your website, and we can stay on as administrator if you want us to. Hosting and domain costs are billed at our cost, and ongoing maintenance is a separate agreement. Managed IT plans are subject to the written plan terms you agree to when you sign up, which control if they differ from these Terms.
14. If We Disagree
If you’re not happy with something, tell us first and we’ll work to make it right. If we can’t resolve a dispute together, we both agree to try mediation before going to court, and we’ll split the mediation costs equally. Either of us may use small claims court for disputes within its jurisdiction without mediating first.
15. General
- Governing law and venue. These Terms are governed by Michigan law, and any legal action will be brought in the courts of Michigan.
- Events beyond our control. We aren’t liable for delays or failures caused by events outside our reasonable control, such as severe weather, power or internet outages, illness, or government action. This does not excuse payment for services already performed.
- Severability and survival. If any provision of these Terms is held invalid or unenforceable, that provision will be modified to the minimum extent necessary, and all remaining provisions stay in full force. Provisions regarding payment obligations, limits of liability, data responsibilities, indemnification, and dispute resolution survive the completion or termination of services.
- Entire agreement. These Terms and our Privacy Policy are the complete agreement between you and HTS about our services.
- Changes. We may update these Terms. The current version is always posted here with its effective date, and the version in place when you book applies to that service, and a later change does not alter work already completed.
Questions before you book? Call us and we’ll talk it through, no charge for that.
